Article 403: If the seller should, in any way whatever, demand the payment of the purchase money, and if it apperars from the evidence that his intention was to oblige the purchase to complete the sale, his option will be extinguished.

ماده 403: اگر بایع به نحوی از انحاء مطالبه ثمن نماید وبه قراین معلوم گردد که مقصود التزام به بیع بوده است خیار او ساقط خواهد شد.

Article 404: should the seller, within three days from the date of the sale, deliver the whole of the object of sale to the purchaser, or should the purchaser pay the whole of the consideration, the seller will no longer have any right to rescind the contract, even thought it should happen, in any way whatever, that the object of sale return to the seller or the consideration to the purchaser. 

ماده 404: هر گاه بایع در ظرف سه روز از تاریخ بیع تمام مبیع را تسلیم مشتری کند یا مشتری تمام ثمن را به بایع بدهد دیگر برای بایع اختیار فسخ نخواهد بود اگر چه ثانیا" به نحوی از انحاء مبیع به بایع وثمن به مشتری برگشته باشد. 

Article 405: If the purchaser offers the price and the seller refuses to accept it, he losses his right to cancel the contract.

  ماده 405: اگر مشتری ثمن را حاضر کرد که بدهد وبایع از اخذ آن امتناع نمود خیار فسخ نخواهد داشت.  

Article 406: The option of delay is purely for the seller: the purchaser does not enjoy this right of option owing to a delay in the delivery of the object of sale.

ماده 406: خیار تأخیر مخصوص بایع است وبرای مشتری از جهت تأخیر در تسلیم مبیع این اختیار نمی باشد.

Article 407: The payment of part of the consideration, or the delivery of same to a person who is not authorized to receive it, does not avoid the option of the seller.

ماده 407 : تسلیم بعض ثمن یا دادن آن به کسی که حق قبض ندارد خیار بایع را ساقط نمی کند.

Article 408: If the purchaser gives surety for the consideration, or if the seller draws a bill for the consideration and the bill is honoured, the option of delay is void.

ماده  408: اگر مشتری برای ثمن ضامن بدهد یا بایع ثمن را حواله دهد بعد از تحقق حواله خیار تأخیر ساقط می شود. 

Article 409: If the object of sale is one of those things which spoils deteriorates before the expiration of three days, the commencement of the option is from the time that the object of sale is about to spoil or to deteriorate.

 ماده 409 : هرگاه مبیع از چیزهایی باشد که در کمتر از سه روز فاسد ویا کم قیمت می شود ابتدای خیار از زمانی است که مبیع مشرف به فساد یا کسر قیمت می گردد. 

Fifth option

On the option of inspection and incorrect description

Article 410: If  a  person should buy a thing from its description only without having seen it, and should then find on inspection that it does not possess the description which had been made , he has the option of either canceling the sale or of accepting the object as it is.

در خیار رویت وتخلف وصف

ماده 410:هرگاه کسی مالی را ندیده و آن را فقط به وصف بخرد بعد از دیدن اگر دارای اوصافی که ذکر شده است نباشد مختار می شود که بیع را فسخ کند یا به همان نحو که هست قبول نماید.
